The User, an individual or a legal entity duly represented, who accesses the Website and agrees to these Terms and Conditions.

By accessing and using the Website, the User explicitly and unreservedly accepts the conditions set forth in this document. If the User does not agree with these Terms and Conditions, they should not access the Website or use the associated services.

1. Definitions

For the purposes of these Terms and Conditions, the terms and expressions below shall have the meanings assigned to them, regardless of whether they are used in the singular or plural:

1.1. Personal Data: Information related to an identifiable or identified User collected and processed by LACS for the purposes described in the Privacy Policy, in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679) and applicable legislation.

1.2. Device: Electronic equipment (such as computers, tablets, or smartphones) used by the User to access the Website and Services provided.

1.3. LACS: Refers to EMPATHY TALENT, LDA., Tax ID 513507728, headquartered at Edifício LACS, Rocha Conde de Óbidos, 1350–352 Lisbon, the entity responsible for managing and providing the Website and its Services.

3.1. The Website is provided “as is,” designed with the User’s interests in mind. LACS does not guarantee uninterrupted operation or that the Website will be error-free.

5.4. The coworking spaces mentioned on the Website are subject to their specific contractual rules, not regulated by these Terms and Conditions. The use of coworking services is governed by a separate agreement specifying applicable terms and conditions. Users are encouraged to review the specific terms provided by LACS before contracting such services.

6. Liability

6.1. LACS is not responsible for damages resulting from:

  1. Devices used by the User to access the Website;
  2. Issues with the use or inability to use the Website and Services, including delays, interruptions, or errors;
  3. Internet or electronic system failures;
  4. Suspension, malfunction or unauthorized use of the Website’s servers;
  5. Failures in third party systems or networks connected to the Website;
  6. Illegitimate acts by third parties;
  7. Errors or security breaches caused by outdated devices or browsers, electronic communication services used by the User or the inappropriate use of passwords or identifications;
  8. Force majeure, such as natural disasters, cyber attacks or infrastructure failures;
  9. Information made available on the Website, not guaranteeing its updating, accuracy, completeness or suitability.

6.2.  LACS shall not be liable for damages, including loss of profits, data or other losses, unless directly attributable to its actions. It is not responsible for: (i) errors or inaccuracies in the information provided; (ii) damages caused by third parties, including subcontractors; (iii) failures arising from compliance with judicial or administrative decisions; (iv) indirect losses, such as loss of profits, income, contracts or savings.

6.3. LACS shall not be liable for delays, defaults or failures to comply with its obligations caused by force majeure.

6.4. LACS shall not be responsible, directly or indirectly, for the content, security and compliance of external platforms accessible from the Website.

7. Website Management

7.1. LACS is responsible for managing the Website and may, at any time, update, modify or delete any of the content and functionalities provided, as well as modify its presentation, configuration, options and functionalities.

7.2. LACS reserves the right, at any time, without prior notice and at its sole discretion, to update, delete or modify the configuration, options and functionalities of the Website and access to the Services.

7.3. LACS may, at any time, cease, suspend, block, interrupt or discontinue part or all of the Services, terminate the licensing of the Website, or impose restrictions or limitations on access, due to technical, commercial, legal, strategic constraints or for violation of the conditions of use by the User.

8. Final provisions

8.2. The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

8.3. These Terms and Conditions shall be governed by Portuguese law and, in the event of any dispute over the interpretation or application of these Terms and Conditions, the courts of the district of Lisbon shall have jurisdiction, expressly waiving any other jurisdiction.
